יואב גלנט הרוב היהודי יאבד; כל גבולותינו יתחממו 09/12












האלוף במיל. יואב גלנט, האיש שכמעט והפך לרמטכ"ל, חושף תחזית קודרת על מצבה של ישראל בעתיד הקרוב: "שמורת הטבע של העם היהודי מאבדת את צביונה. בעוד 15 שנה ישראל תאבד את הרוב היהודי לטובת ערבים, תיאלדנים וסודנים" על סוריה: " אסד סיים את תפקידו ויחל עידן הסונים... וחיזבאללה עם 50 אלף טילים נכנס לפינה" על ירדן: "אחרי עידן אסד - הבלגן יעבור לשם" על מצרים: "סיכוי גדול שניכנס עימם לעימות צבאי"

"אם לא תהיה הפתעה מיוחדת, אז בעוד 15 שנה יהיו ממערב לשבר הסורי אפריקני 8 מיליון יהודים ו-8 מיליון לא יהודים, שזה בעיקר ערבים וגם קצת תיאלנדים, סודנים ואחרים" - כך אמר האלוף במיל. יואב גלנט, שכמעט מונה לרמטכ"ל ומינויו בוטל בעקבות פרשת הקרקעות, בדברים שנאמרו בשיחות סגורות בפני מספר סטודנטים צעירים, בוגרי מלגת אימפקט, בתל אביב. הדברים נחשפו על-ידי עיתון "מקור ראשון" וכתבו ישי פרידמן.
"אני אומר 'הפתעה', במובן שיש לנו את היכולת אחת לעשור, או דור, למצוא איזה שבט נידח - פעם זה ברוסיה ופעם זה באתיופיה ופעם במקום אחר אבל זה פחות או יותר הולך ומתמצה".
"מדינת ישראל הוקמה כלקח של העם היהודי שאומר, בגדול: חיינו אלפיים שנה בגלות. נתנו לעולם את התנ"ך, את שפינוזה, איינשטיין, את הרמב"ם וגם את ברברה סטרייטנד וקיבלנו בתמורה רדיפות, פוגרומים, אינקוויזיציה ובסוף שואה והפתרון היחיד הוא שלעם הנכחד הזה יהיה מקום להניח בו את הראש ולשים את הרגליים ובו הוא יכול להגן על עצמו בכוחות עצמו. במובן הזה הוקמה פה שמורת טבע שבה יהודים יוכלו להגן על עצמם בכוחות עצמם. שמורת הטבע הזו למעשה הולכת ומקבלת צביון שונה. עכשיו, האם יהיו פה בסוף יותר לא יהודים מיהודים ולאן זה יילך, אינני יודע אבל הנושא הזה צריך לקחת אותו בחשבון על כל המשמעויות. אומנם זו לא עובדה, אבל זה הכי קרוב לעובדה כתחזית סטטיסטית".
בהתייחסו לתהפוכות בעולם הערבי, אמר גלנט כי מדובר בשינוי שלא היה כדוגמתו, וכי כוונתו לכך שכל השליטים באזור התבססו על צבא וכוחות ביטחון כמקור הכוח שלהם וביסודו של דבר הם היו דתיים לכאורה וחילונים למעשה, והם התבססו על כוחות צבא קודם כל כדי להשליט את השלטון שלהם על העם שלהם בראש ובראשונה. "בשנת 1920 אחד בשם אל באנה מקים ארגון בשם האחים המוסלמים במצרים. במקביל קם ארגון דומה בפקיסטן והם יושבים על הקווים ומחכים להיכנס למשחק במשך שמונים, תשעים שנה, מחכים להיכנס למשחק ובפעם הראשונה שהם נכנסים למשחק היא במהפכה שמתחוללת בעזה בתמיכה אמריקנית ובהסכמה ישראלית כשהחמאס לוקח את השלטון בבחירות, ואחד שקורא מודיעין כמוני מסתכל מה כתוב ושואלים את חמאס מודע אתם הולכים לבחירות והם עונים משהו בסגנון 'אין לנו ברירה אלא להשתמש בשיטה שהמציאו הכלבים הציוניים והאמריקנים שנקראת דמוקרטיה'. זה מה שנקרא מסמר בלי ראש הכנסת אותו פעם אחת .. בואו נראה מתי יהיו הבחירות הבאות בעזה לדעתי אנחנו נחכה זמן".
גלנט טוען כי המוסלמים מנצלים את הדמוקרטיה בחסות האמריקנית כדי להרחיב את השליטה. לגבי סוריה דעותיו של גלנט נחרצות ביותר: "אסד ועדת העלוואים סיימו את תפקידם בהנהגת המדינה הסורית. העתיד שייך לסונים. בשאר אל אסד עוד לא הגיע לכמות ההרוגים שאביו חאפז אל אסד הרג בחודש או בשבוע. אם היום בדמשק יש מרידה של סונים נגד בשאר אל אסד זה אחרי שיש להם זכרון היסטורי של עשרות אלפי הרוגים המשמעות היא שהעניין הזה עבר את הסף שאפשר לשלוט עליו. אני בניגוד לאחרים לא מתכוון להתנבא מתי תהיה החלפת שלטון אבל אני יכול לומר דבר אחד: באשר אל אסד הוא השליט העלוואי האחרון בעת הזאת. השליט הבא יהיה סוני", קובע גלנט.

"יש רובד של אוכלוסיה מאוד קיצונית בתוך מצרים. אנשים שבשבילם ישראל זה דבר שצריך להיעלם מהמפה", אמר גלנט וסיפר: "כשהייתי המזכיר של שרון והייתי מגיע לשגרירות במצרים ושם הייתי פוגש את ידידנו עומר סולימן, אללה ירחמו, וישבתי איתו והסתכלתי על הקיר שממול שם יש לוח מודעות בגודל של עשרה מטרים ומראים בו חמישה ראשי ממשלות לשעבר במין קריקטורה כזאת שהם אוכלים ילדים פלשתינים והדם שלהם נוזל על הקרטון, וכשאתה אומר לעומר סולימן למה אתם מאפשרים את הדבר הזה? הוא היה אומר 'זו מדינה דמוקרטית. כל אחד עושה מה שהוא רוצה. העיתונות כותבת. זה מפרסם על לוח מודעות. אין לנו מה לעשות נגד זה'".
"ואני אומר את זה בצורה הכי בוטה והכי קשה. חוץ מתעמולת הזוועות של גבלס במלחמת העולם ולפניה", קובע גלנט, "אין תעמולה קיצונית וארסית נגד מדינת ישראל יותר מאשר התמונות בעיתונות המצרית. אני מציע לכם להיכנס לאינטרנט ולראות איך הדבר הזה נראה. על בסיס השנאה הזאת אני יכול לומר, לצערי, כשמסתכלים על השנה-שנתיים האחרונות, אנחנו הגענו אחרי שלושים שנה של שלום בחזרה למצב של שביתת נשק. אין מלחמה, אבל זה לא בדיוק שלום. אני לא חושב שמצרים רוצה להילחם בישראל, אבל מלחמות נוצרות לפעמים בדרך אחרת, לא כתוצאה של רצון של מנהיג או שליט. אם פעם האחים המוסלמים ישבו בעמדה מאוד נוחה בעמדת הווטו ומובארק עשה משהו, הם אמרו 'לא בסדר'. היום זה אחרת. הם אחראים. בפעם הבאה שיהיו מהומות-לחם, מה יהיה? כבר אי-אפשר יהיה להאשים את מובארק. עכשיו, מה בדרך כלל קרה בעולם במשך מאות שנים במצבים כאלה? שנאת הזר. יסבירו להם: הציונים לקחו לכם את האוכל, גנבו את מדבר סיני. לא משנה, איזה סיפור שאתם רוצים... הם בכלל מאיימים על מוחמד והם מפיצים עליו קריקטורות ואני יכול לספר לכם... תקראו פעם על הסיפורים של המצרים, שהם מאמינים בהם שהסוכנות של המוסד מפיצה איידס ועד מה שאתם רוצים, סיפורים לא הגיוניים. אבל בלתי הגיוניים זה דבר אחד ושמונים אחוז מהאוכלוסיה שמאמינה בזה זה דבר אחר, ואין לנו ברירה כמצרים אלא להכניס דוויזיה אחת או שתיים לסיני והתהליכים מתחילים לזרום. אני לא חושב שלמצרים יש עניין לעשות מלחמה אבל אני חושב שהסיכוי שכתוצאה מבעיות פנים אנחנו נמצא את עצמינו במתיחות הולכת וגדלה עם מצרים, הוא סיכוי מאוד טוב ומאוד מדאיג".

המוטיב העיקרי החוזר על עצמו בקריקטורות ערביות בנוגע לישראל הוא "היהודי השטני". דימוי זה משדר את הרעיון שהיהודים מתנהגים כמו הנאצים, הורגים ילדים ואוהבים דם. הדמיון לנושאים שפורסמו על-ידי הנאצים ניכר לעין. קריקטורות ערביות רבות משבחות פיגועי התאבדות או קוראות לרצח. הדימוי הקיבוצי של היהודים המוצג בצורה זו מכשיר את הקרקע להשמדת עם אפשרית.לקריקטורה עלולה להיות השפעה על דעת הקהל לא פחות מאשר למאמר מערכת.הקריקטוריסטים הפלשתינאים שמים לעתים קרובות דגש על ההאשמות האנטישמיות ב"רצח פולחני" של ילדים, וטענה זו מודגשת על-ידי טיעונם שהישראלים פוגעים בילדים פלשתינאים. כדי לשלול מהיהודים צלם אדם, הקריקטוריסטים הערבים מתארים אותם לעתים קרובות כיצורים שוחרי רע: עכבישים, ערפדים או תמנונים.כמה ממוטיבי השנאה הערביים חלחלו גם לחברה המערבית, והם מגבירים את הדעות הקדומות האנטישמיות הוותיקות של העולם הנוצרי.הנחת יסודות להשמדת עם"הדימוי הקיבוצי של היהודים שנוצר על-ידי הקריקטורות הערביות מניח את היסוד לאפשרות של השמדת עם. אוסף הקריקטורות הערביות הנמצא ברשותי ממחיש זאת. אפשר להתווכח אם הרעיונות הללו בדבר השמדת עם הם מודעים או תת-הכרתיים. דעתי היא שהם נמצאים עדיין בשלב התת-מודע".ד"ר יואל קוטק, איש מדע המדינה באוניברסיטה החופשית של בריסל, חיפש יום-יום באינטרנט, במשך יותר משנתיים וחצי, אחר קריקטורות אנטישמיות באמצעי התקשורת הערביים ומצא כ-2,000 קריקטורות. גם ניתוח שטחי ראשוני גילה שהקריקטורות לא מכוונות רק לישראל אלא לכל היהודים. המחקר שערך לאחר מכן הניב ספר שנכתב על ידו ועל-ידי אחיו, דן קוטק. הספר פורסם בצרפתית, וכותרתו היא  בשם האנטישמיות: דימויי היהודים וישראל בקריקטורות מאז האינתיפאדה השנייה.1בעולם שבו הדימויים ממלאים תפקיד מרכזי, מדגיש קוטק, נעשתה הקריקטורה לאמצעי תקשורת פופולרי ויעיל. לקריקטורה יש השפעה על דעת-הקהל לא פחות מאשר למאמר מערכת.ההשפעה החזותית של הציורים הללו שואבת חיזוק נוסף עקב העובדה שקריקטוריסטים ערבים רבים הם מאיירים מחוננים למדי."המוטיב העיקרי החוזר על עצמו בקריקטורות ערביות בנוגע לישראל הוא 'היהודי השטני'", אומר קוטק."אם נרחיב אותו, הדימוי הזה גורס שהדת היהודית חייבת להיות דת שטנית ומרושעת, ושכל העם היהודי מרושע. מצאתי אפילו קריקטוריסט יווני-אורתודוקסי אחד, ממוצא לבנוני, שמשדר את המסר כי הדת היהודית היא שגרמה למדינת ישראל להיות כל כך 'מרושעת'. הקריקטורות מבטאות את הרעיון שהיהודים מתנהגים כמו הנאצים, ומניעות את הקוראים להגיע למסקנה שהפתרון ההגיוני היחיד הוא חיסולם. מכיוון שהעולם הערבי נעשה משוכנע יותר ויותר בדעות האלה, אין להם שום עכבות מלהציג אותן בשפע של אתרי אינטרנט".עשרה נושאים עיקרייםכמה מאות קריקטורות ערביות מהאוסף של קוטק סווגו בספרו לפי עשרה נושאים אנטישמיים:"הנושא הראשון מבוסס על המוטיב האנטישמי הישן ביותר - השמצת היהודי. מעמדם של היהודים בעולם האיסלאם - כמו מעמדם של הנוצרים - הוא של ד'ימי - אזרח סוג ב'.      ישראל, מדינה שלמה של 'יצורים נחותים' אלה, זכתה בניצחונות צבאיים על העולם הערבי. לפי ההיגיון שלהם זה היה אפשרי, כך הם מאמינים, רק מפני שהיהודי מתואר כלא אנושי ואויב האנושות. שלילת צלם האנוש הזאת דרושה כדי להצדיק את ההשמדה שהם מקווים להגיע אליה.      ב-28 בדצמבר 1999 - זמן רב לפני ההתקוממות הפלשתינאית השנייה - פרסם העיתון אל-חייאת אל-ג'דידה -  הביטאון הרשמי של הרשות הפלשתינאית, קריקטורה המבטאת את הדעה המרכזית הזאת. בקריקטורה צויר אדם זקן הלבוש בגלבייה ומסמל את המאה ה-20, כשהוא נפרד מאדם צעיר הלבוש בחולצת טריקו המסמלת את המאה ה-21. ביניהם עומד יהודי קטן עם מגן-דוד על חזהו, ומעליו מצויר חץ המכוון אליו ואומר: 'מחלת המאה'.2      כעבור כמה חודשים, ב-22 במרס 2000, פרסם אותו העיתון קריקטורה נוספת המראה אפיפיור גדול המשוחח עם יהודי קטן שעורו, רגליו וזנבו הם כמו של חיה, ובעל אף גדול ומעוקל, החובש כיפה. האפיפיור קורא: 'שלום עלי אדמות', ואילו היהודי הנראה כמו שטן קורא 'התנחלויות עלי אדמות'".3 רצח האלנושא מרכזי שני בקריקטורות שאסף קוטק הוא היהודי כרוצח האל."במקורו, זה מוטיב נוצרי. ברנרד לואיס הראה כיצד הופקע הנושא הזה על-ידי עולם האיסלאם. המצגת הזאת משרתת את המאמצים לרכוש את אהדתם של נוצרים מסוימים על-ידי התאמת אחד המיתוסים המרכזיים שלהם.      לואיס אמר כי מקור הביטויים הראשונים של האנטישמיות במזרח התיכון היה בקרב מיעוטים נוצריים שקיבלו את השראתם מהאירופים. לרעיונות אלה היתה תחילה השפעה מוגבלת. הרעל החל להתפשט אחרי 1933, כשגרמניה הנאצית טיפחה את שנאת היהודים בעולם הערבי. מכאן ואילך אִפשר הסכסוך הפלשתינאי את הפצת הפרשנות האנטישמית להיסטוריה.4      לפי השקפת העולם המוסלמית אין אדם יכול להרוג את האל, אבל הוא יכול לפצוע אותו. השיג ושיח המוסלמי גורס כי לא זו בלבד שהיהודים בגדו במוחמד, אלא שעוד לפני כן הם הפכו את ישו - נביא, על-פי האיסלאם - לקדוש מעונה. במוטציה מסוכנת, אומרת האנטישמיות האיסלאמית, כאילו הערבים הם נוצרים, היהודים מתייחסים לפלשתין כשם שהתייחסו לישו. בצורה זו הם משנים את הדמויות העיקריות בסיפור: הישראלים נעשו רומאים וישו נעשה פלשתינאי.      בכל פעם שיש דיווח מבית-לחם, החיילים הישראלים מתוארים על-ידי הקריקטוריסטים הערבים כרומאים, ואילו בית לחם מתוארת כמקום לידתו של ישו. בעולם האיסלאם, המוטיב של יהודים הפוצעים את הנביא אינו עתיק. ממציאיו הם ערבים נוצרים בשנות השמונים של המאה האחרונה".ישראל כמדינה נאצית"המוטיב השלישי בקריקטורות אלה הוא ישראל כמדינה נאצית. טיעון זה מבוסס על שתי האשמות סותרות, שהאיסלאמיסטים מנסים ליישב ביניהן. טענתם הראשונה היא שהשואה מעולם לא התרחשה, והטיעון השני שלהם הוא שאם אכן היתה שואה, היא גרמה נזק גדול יותר לפלשתינאים, מפני שהם מאמינים שהיחס כלפיהם גרוע יותר מזה שבו התייחסו הנאצים ליהודים.      הנושא של ישראל כמדינה נאצית הוצג בשפע בקריקטורות הערביות, עוד זמן רב לפני ששרון עלה לשלטון. לפי טיעון זה, כל הציונים - מפרס וברק ועד שרון - שואבים השראה מהשיטות הנאציות. הפרדוקס בולט היטב לעין אם זוכרים את אהדתם של הערבים לנאצים בימי מלחמת-העולם השנייה. אחרי המלחמה הכחישו אינטלקטואלים ערבים רבים את הפשעים שביצעו הנאצים בתקופת השואה. אלה כמעט שלא גונו.      קריקטורה שהופיעה באל-אח'באר  המצרי מציגה את ברק לבוש כנאצי, עם שפם של היטלר, ודם נוטף מידיו. בקריקטורה אחרת, שהופיעה ביומון המצרי אל-גומהורייה ב-1996, נראה היטלר שהוא עונד על זרועו סרט עם צלב הקרס, ואומר לשמעון פרס, העונד על זרועו סרט עם מגן-דוד: 'עשיתי שגיאה כשלא הבנתי את חשיבות התמיכה של האמריקנים'.6      ב-1993 פרסם היומון הסורי תישרין קריקטורה המראה חייל אחד עם מגן דוד על קסדתו, וחייל אחר עם צלב קרס על הקסדה. בכיתוב נאמר: 'מועצת הביטחון בחנה את פרשת השמדת העם הפלשתינאי'. הרשימה הארוכה היא של פשעי ישראל; הרשימה הקטנה היא של פשעי הנאצים.7 בשנת 2000 פרסם הדיילי סטאר הלבנוני ארבעה ציורים רצופים כיצד הופך שרון, עם מגן דוד על דש בגדו, להיטלר עם שפם, כשעל דש בגדו מופיע צלב קרס. הקריקטוריסט, ג'ברה סטאברו, שנולד בביירות, זכה בפרסים רבים".8 ייחוס צורות או תכונות של בעלי-חיים לבני אדם (זואו-מורפיזם)"המוטיב הרביעי", אומר קוטק,"ייחוס צורות או תכונות של בעלי-חיים לבני אדם (זואו-מורפיזם), הוא נושא נפוץ מאוד בכל רחבי העולם. כדי לפגוע ביריבים ולגדף אותם, שוללים מהם צלם אנוש והופכים אותם לחיות. בקריקטורות הנאציות, הסובייטיות והרומניות היהודי מתואר לעתים קרובות כעכביש, הנחשב לבעלי-חיים מרושע. סטאברו מצייר את ברק, בדיילי סטאר, כעכביש המפריע לתהליך השלום כשמגן דוד על חזהו.9      שני המוטיבים הזואו-מורפיים האנטישמיים המכריעים הנוספים הם הערפד צמא הדם והתמנון. דמות הערפד היא נושא קלסי שהאנטישמים משתמשים בו. לא מצאתי שום אנשים אחרים המוצגים כך, מלבד היהודים. המתכונת הזאת, להכשרת השמדת עם, צמחה מהדמיון הנוצרי.      בקריקטורה אחרת, פרי עטו של סטאברו בדיילי סטאר מ-23 באוקטובר 2000, צויר עכביש שמגן דוד על גופו ועם ראש של אהוד ברק בתוך רשת שבה מופיעה המילה 'מלחמה' פעמים רבות. בקריקטורה שהתפרסמה בשבועון La Revue du Liban, נראה תמנון עם מגן דוד על גופו, כשזרועותיו חונקות את הפתח, הג'יהאד והחמאס. גם זו קריקטורה של סטאברו.10     ככל שמדובר בתצוגה חייתית של היהודים, במקרים רבים מחקה הקריקטוריסט הערבי את הנאצים. השדרים המועברים הם שהיהודים הרסניים, לא אנושיים ומרושעים. ב-1934 צייר קריקטוריסט נאצי תמנון עם מגן דוד שזרועותיו מקיפות את כל העולם.11  קריקטורה רוסית משנת 2002 מראה מגן דוד שאמריקה משליכה עליו מטבעות. לאחר מכן המגן דוד משנה את צורתו והופך לתמנון עם רקטות ומטוסים בזרועותיו.12  נחשים, חזירים ומקקים"מפעם לפעם משתמשים בחיות אחרות כדי לשלול מהיהודים דמות אנוש. עימאד חג'ג', קריקטוריסט ידוע, יליד רמאללה המתגורר בירדן, צייר נחש דו-ראשי עם מגני דוד על גופו, המתאר את ראשיהם של שרון ושל ברק.13  המסר של הקריקטורה פשוט: אנשים אלה הם שני פניה של המפלצתיות. הקריקטורה פורסמה ביומון הירדני אל-דוסתור.      לפעמים אפשר למצוא בקריקטורות הערביות בנות זמננו גם חזירים המייצגים את היהודי. מקורו של מוטיב קלסי זה, השולל את צלם האנוש, בימי הביניים, אף כי כולם יודעים כי החזיר הוא בעל-חיים האסור ליהודים.      גישה זו, של זואו-מורפיזם, קיימת בכל תרבות, ויש לה מאפיינים תרבותיים. בנחש משתמשים כמעט כולם. הוא הופיע לעתים קרובות מאוד בקריקטורות צרפתיות בקשר לגרמנים לפני מלחמת-העולם השנייה, ולהפך. בני שבט ההוטו באפריקה רואים בבני הטוטסי מקקים.     בעיתונות הישראלית מופיעות רק לעתים נדירות קריקטורות המתארות את הערבים כחיות. במקרים כאלה, הם אינן מופיעות בעיתוני הזרם המרכזי, אבל מקורן בגופים קיצוניים כגון תנועת 'כך' שהוצאה אל מחוץ לחוק או ב'נשים בירוק'. אלה מציגים את ערפאת מפעם לפעם כחזיר או נחש".14 "אדוני העולם" "המוטיב האנטישמי החמישי בקריקטורות הערביות מזכיר את נושא הקנוניה הקלסי, ש'היהודים שולטים בעולם'. זה מסביר את דעתם של הערבים מדוע לא עלה בידם לנצח את העם הזה. הנושא הקלסי, לפני 1967 - וגם בעולם הסובייטי - היה שישראל היא נושאת-המטוסים של ארצות-הברית במזרח התיכון.      כיום מתואר הרעיון ההפוך. יריבי ישראל טוענים כי היהודים שולטים בארצות-הברית. ומכיוון שכך, הם טוענים גם שהיהודים הם 'אדוני העולם' - נושא 'קנונייתי' קלסי שהנאצים עשו בו שימוש. בעיני הקומוניסטים, היהודים היו בורגנים וקפיטליסטים; בעיני הנאצים הם ייצגו את תמצית מהותו של הקפיטליזם.      ערבים רבים תוהים מדוע תומכת ארצות-הברית בישראל ולא בענייניהם. הם סבורים שזו תופעה מסתורית, ולכן הכינו תשובה פשוטה: היהודים שולטים בעולם. מכיוון שהעולם הערבי נמצא במצב גרוע למדי, הטענה שהם אדוני העולם, כלומר היהודים, היא שורש הבעיות שלהם. המוטיב הזה זהה לזה שהודגם בזיוף הפרוטוקולים של זקני ציון שהוכן ברוסיה הצארית. כך הם רוצים להיפרד, באופן תת-הכרתי, מ'אנשי הקנוניות המרושעים' האלה, והם מוצגים לעתים קרובות כיהודים חרדים, שהוא אבסורד נוסף.       בֶּנְדיב, הקריקטוריסט האמריקני המחונן ממוצא אלג'יראי, צייר קוף עם מגן דוד על חזהו היושב על כדור הארץ שעליו מצוירות דמויות קטנות של האפיפיור ושל ערבי. הקוף אומר: 'ירושלים: מניו-יורק ועד קואלה לומפור, בלתי מחולקת, בירת הנצח של עם ישראל; כל היתר פתוח למשא-ומתן'.15  מוטיב השליטה בקריקטורה זו משולב אפוא עם הזואו-מורפיזם".היהודי, כוח משחית"המוטיב האנטישמי השישי, החוזר על עצמו, הוא היהודי ככוח משחית. זוהי נגזרת של הנושא כי היהודים שולטים בעולם באמצעות כספם. האנטישמים הערבים טוענים כי נשיאי ארצות-הברית מחוברים לבנקים יהודיים ולכסף יהודי אחר. אלא שמה הערבים שוכחים הוא כי ג'ורג' ו' בוש היה המועמד שלהם בבחירות האחרונות שנערכו באמריקה. רוב היהודים, שהם ליברלים ולכן דמוקרטים, הצביעו בשביל אל גור. היהודים תמכו גם בקלינטון. אבל לפי התפיסה של הקריקטוריסט, הכל נעשה אפשרי.      בנדיב מצייר את אלוהים המחזיק בידו שק גדוש דולרים, שעליו מופיעים שמות ארגונים יהודיים גדולים:  ADL, אייפאק, ZOA. אלוהים מושיט את ידו לבוש, השוחט ילד על מזבח 'קרן ארץ הקודש' לילדים מוסלמים נזקקים. בכיתוב נאמר: 'והדולר הכל-יכול [המיוצג על-ידי אלוהים] אמר: "הקרב אותי, בן מוסלמי, אחרת...". וג'ורג' בוש אומר: "הבנת את זה, אלי - אם זה ישפר סיכויי לתקופת כהונה שנייה'".16   "קריקטורה שהופיעה בתישרין מציגה יהודים מזוקנים עם פיאות ושק הדורכים על היטלר כדי להגיע לכספת פתוחה עם כסף שעליה כתוב 'ארצות-הברית'. השואה מוצגת אפוא כמוטיב לסחיטה על מנת להוציא כסף".17 מוטיב עלילת-הדם"נושא מרכזי נוסף בקריקטורות הערביות הוא היהודי אוהב הדם או הצמא לדם. מקורו באנטישמיות הנוצרית. הדיבה האנטישמית הנוצרית טענה כי היהודים זקוקים לדם נוצרי עבור פולחני הפסח שלהם. הם טוענים שהיהודי מרושע, מפני שדתו מאלצת אותו לשתות דם. בעולם הערבי של ימינו, הדימוי הזה של שנאה מופקרת לבש צורה של שאיפה להשגת דם פלשתינאי.      יש כל-כך הרבה קריקטורות כאלה, עד שיכולתי לבחור רק מעטות מהן בשביל הספר שלי. יהודים שותי דם מוצגים לעתים קרובות באל-אהראם, אחד היומונים המובילים במצרים. ב-21 באפריל 2001 הדפיס העיתון קריקטורה המראה ערבי המוכנס למכבש מתכת על-ידי שני חיילים החובשים קסדות עם מגני דוד. דמו של הערבי נוזל החוצה, ושני יהודים חובשי כיפות ומגני דוד על חולצותיהם שותים את הדם כשהם צוחקים.18 קריקטורה מצרית ידועה נוספת מציגה את שרון עם קרניים ודם נוזל מפיו.19 מהברז האמריקני נוזל נפט, מהברז הטורקי - מים, ומהברז הישראלי - דם".20 קוטק אומר שלמיטב ידיעתו נושא הדם הוא נושא אנטישמי, ולא נושא גזעני כללי. שום עם אחר לא הואשם בשתיית דם. מקורות המיתוס הזה טמונים באנגליה הנוצרית של המאה ה-12, שם הומצאה עלילת הדם.רצח ילדים"הנושא האנטישמי השמיני החוזר על עצמו בקריקטורות הערביות הוא הקיצוני ביותר. הקריקטוריסטים מנסים לשדר בעזרת הדימויים שלהם את התפיסה שהיהודים לא רק רוצחים,  אלא מחפשים בעיקר ילדים. וכך הם מציגים את הפלשתינאים  בעיקר כילדים או תינוקות. לפיכך, התעמלנים הערבים והמוסלמים הופכים את הילדים הפלשתינאים לנוסחת הקרבן, על אף העובדה שרוב ההרוגים שלהם הם ילדים".      קוטק מציין כי  "הפלשתינאים אכן חיים בטרגדיה מדי יום, ובעשור האחרון היו להם כ-5,000 הרוגים. גם ישראלים רבים נהרגו. סודאנים נהרגו; שלושה מיליון אפריקנים סביב האגמים הגדולים; 200 אלף בוסנים; 150 אלף אלג'יראים ו-100 אלף צ'צ'נים. אבל התקשורת מתרכזת בפלשתינאים.      קריקטורה פלשתינאית מראה את הדמות של פסל החירות המרימה את ידה הימנית המחזיקה ילד פלשתינאי נוטף דם. בידה השמאלית היא מגִנה על ברק.21  קריקטורה כווייתית מראה יהודי זקן החובש כיפה ומחזיק רובה בידו, התוחב ילד לתוך תנור בוער כדי לאפות מצות. ההתייחסות היא גם לשואה - שהילד הפלשתינאי עובר אותה עכשיו - וגם לפשע פולחני.22      האתר הרשמי של שירות העיתונות של הרשות הפלשתינאית מפרסם קריקטורה של שרון עם גרזן מכוסה דם הטובח תינוק, או עובר, על רקע של אנקולי קצבים שילדים תלויים עליהם, סמוך לשלט שעליו נכתב 'דם פלשתינאי'. שלט גדול על הדלפק מכריז 'מבצע'.23      בכתב-העת אל-ואטאן, המופיע בקטאר, מוצג שרון כשהוא שותה מספל שעליו נכתב 'דם ילדים פלשתינאים'. בתחתית הספל כתוב: 'תוצרת ארצות-הברית'.24   באל-ח'ייאת אל-ג'דידה  שרון מציע לג'ורג' בוש את ראשו המדמם של פלשתינאי צעיר על גבי צלחת.25 הקריקטורות שהוזכרו קודם לכן, של היהודי כערפד צמא דם. מכניסות את שני הנושאים האנטישמיים למתכונת אחת".הערבים רוצים שלום, ישראל - לא"המוטיב האנטישמי התשיעי שבו נעשה שימוש הוא שישראל היא מדינה 'בוגדנית' שאינה רוצה שלום. נושא 'היהודי הבוגדני' הוא נושא עתיק באנטישמיות האיסלאמית. אומרים שמוחמד ניסה בזמנו לעשות שלום עם היהודים, אבל - כך הם טוענים - הם בגדו בו בשיטתיות, והוא רצח אותם.      רסמי מראה פלשתינאי המשליך את הנשק שלו על הרצפה ואומר: 'אני מוותר על הנשק שלי כדי לשכנע אותך'. חייל ישראלי העומד מאחורי הקיר הורג אותו, ואומר: 'ככה אני מאמין לך'.26  בקריקטורה סורית, מציע ישראלי כדור לערפאת, המחזיק יונה. מלמעלה כתוב: 'הסכמי אוסלו'. הכדור מתפוצץ והורג את הערבי. הישראלי הולך משם וחונק את היונה".27 התנצלויות על המפַגעים המתאבדים ועל הטרור"המוטיב העשירי עוסק בהתנצלויות על המפגעים המתאבדים. אספתי קריקטורות רבות הקוראות לרצח מוחלט. במאות העיצובים שניתחתי בנושא זה לא מצאתי ולו גם אחד המתאר את הישראלי כאזרח. הוא תמיד חייל או יהודי חרדי. אין לו אבא, אימא או ילדים.      קריקטורה ירדנית שצייר רסמי מראה פלשתינאי שפניו מכוסים ודינמיט על גופו, האומר לעולה יהודי מרוסיה המוצג כיהודי חרדי: 'בוא אל זרועותי'.28  קריקטורה אחרת, שצוירה בידי עימאד חג'ג', מראה אם פלשתינאית המרימה את זרועותיה ומרימה את ילדיה המתוארים כמפגעים מתאבדים.29קוטק מגיע למסקנה שהקריקטורות האלה מציגות במקרים רבים סוג חדש של אנטישמיות."הן נקראות לעתים תכופות 'קריאות לרצח'. בעיני הקריקטוריסטים, המוות מצטייר כעונש הראוי היחיד המגיע ל'אויב הציוני'. הגרסה האיסלאמית-הג'יהאדית היא בפירוש גישה של המשדת עם, כפי שמציין פייר-אנדרה טאגיף בספרו על שנאת היהודים החדשה.30  היא מגדירה את מאבקה כהשמדה מוחלטת של האויב הרודני שלה".הקסם שלכד את הילדכשנשאל כיצד החל להתעניין כל-כך בקריקטורות, סיפר קוטק שכשהיה בן תשע - זמן קצר לפני מלחמת ששת הימים - כבר הקסים אותו ספר שפרסם מלומד ישראלי על קריקטורות אנטישמיות:          "יש ספרים שאתה קורא כשאתה צעיר המשפיעים על כל החיים שלך.בלגיה התמקדה תמיד במידה רבה בקריקטוריסטים ובתיאורים הציוריים שלהם. כשאתה חי שם, המוח שלך פתוח יותר לצורת אמנות זו. אפילו כתבתי מאמר על הֶרזֶ'ה, הקריקטוריסט הבלגי החשוב ביותר, שהיה אנטישמי.וכך היתה לי מראש נטייה לקריקטורה. זהו כלי פשוט ומשכנע כדי להציג במהירות את ההתפתחויות הרציניות ביותר המתרחשות בעולם הערבי. בנושאים שלהם משתמשים גם בעולם המערבי. הדמיון בין הקריקטורות האלה לבין הקריקטורות הנאציות בולט לעין, והן כבר הומחשו בספר קודם שפרסם אריה סתיו".31כדי לקבל את זכויות היוצרים על הקריקטורות, כתב קוטק לקריקטוריסטים רבים בעולם הערבי. מכיוון שלבלגיה יש דימוי של מדינה אנטי-ישראלית, בייחוד נוכח התביעה המשפטית שהוגשה נגד שרון, רבים מאלה שפנה אליהם הניחו אוטומטית שהוא אנטי-ישראלי. לא מעטים מהם נתנו לו רשות להשתמש בקריקטורות שלהם ללא תשלום.איש ימין במחנה השלום"באירופה, כשאתה מתנגד לגזענות, זה הופך אותך אוטומטית לשמאלן. אבל כשאתה נאבק באנטישמיות אתה נתפס כאיש הימין - תומך הליכוד ושרון. זה לא נכון, מפני שאני יהודי בעל הכרה המשתייך למחנה השלום. אני רואה את עצמי כידיד ישראל, אולם ביקורתי כלפי אחדים מקווי מדיניותה. אולם ברגע שאתה נעשה מודע לשנאה הערבית האיומה ולהשמצת ישראל, אתה חייב להגן על ישראל. אני מזועזע מההשלכות של האנטי-ציונות בשילוב עם בורות נוראה ביחס לישראל שאני מוצא לעתים קרובות בקרב אנשים שונים.הקריקטורות בספר שלי, המייצגות אוסף גדול הרבה יותר, מראות כיצד מיתוסים נוצריים ישנים על היהודי השטני קמים לתחייה בעולם הערבי. קריקטוריסטים פלשתינאים שמים לעתים קרובות דגש על רצח פולחני של ילדים, ואחר כך הם מנסים להגן על עמדתם בטענה שהישראלים פוגעים בילדים פלשתינאים".קוטק אומר שהטענות האלה חלחלו גם לחברה המערבית, מפני שהן עולות בקנה אחד עם הדעות הקדומות הישנות של העולם הנוצרי. הוא עוקב מקרוב אחר אמצעי התקשורת הצרפתים והבלגים:"זה קורה כל הזמן: אם הרדיו הצרפתי או הבלגי מדווח על פלשתינאי שנהרג, הם מדווחים גם על גילו. זהו הסכסוך היחיד בעולם שבו מוזכר גיל הקרבן.אי-אפשר למחוק את המיתוסים האנטישמיים מתת-הכרה הקיבוצית של נוצרים רבים, וכיום - המסורת בעל-פה האיסלאמית (החדית') מצטטת את דברי הנביא מוחמד: "אומתי תתפלג לשבעים ושתיים עדות, ורק אחת מהן תימלט (מהגיהנום)". מאז שמוחמד עצם את עיניו לעולמים בשנת 632 לספירה, עסוקים המוסלמים - בהקשר לאמירה זו - בשתי שאלות, האחת תיאורטית והאחת מעשית. התיאורטית היא מי היא אותה עדה צַדֶּקֶת וצודקת העתידה לרשת את גן העדן, ומי הן כל העדות האחרות ששערי הגיהנום ממתינים להן פתוחים לרווחה. השאלה המעשית, הנובעת מהתיאורטית, היא איך מוודאת כל עדה שהיא - הצַדֶּקֶת והצודקת - חיה בגן עדן כבר בעולם הזה, ואיך היא עושה בו גיהנום לעדות האחרות.

שיעים

העיסוק בשאלות אלה החל מייד אחרי הלווייתו של מחמד, כאשר ישבו זקני המוסלמים להחליט מי יהיה הח'ליף - המחליף - של מוחמד. עלי בן אבי טאלב, בן דודו של מוחמד, שהיה גם חתנו, טען כי הח'ליפות מגיעה לו. אבל טענתו לא התקבלה, ושלושה אחרים מונו לח'ליפים לפניו. 24 שנים ארוכות הוא המתין עד שהתמנה לחליף הרביעי. במשך זמן זה הוא גיבש סביבו קבוצת תומכים, שהיו מוכנים אפילו להיכנס למאבק אלים כדי לכבוש את עמדת השליט. הם היו השיעים הראשונים. המילה שיעה בערבית משמעה "סיעה", כלומר סיעת עלי.

לאחר שנרצח עלי בשנת 661, המשיך בנו, חוסיין, לטעון כי היות שהוא ממשפחת האשם, משפחת הנביא, השלטון שייך לו, ולא לח'ליפים ממשפחת אומייה - ענף אחר של שבט קורייש, שהשתלטו על השלטון. טענתו זו הפכה אותו למורד, ובשנת 680 נתפס על-ידי צבא השלטון ליד העיר כרבלא שבדרום עירק, ונטבח יחד עם מרבית משפחתו ותומכיו. אירוע זה הוא האירוע המכונן של השיעה עד היום הזה, והשיעים מציינים את ה"עאשורא" - היארצייט - של חוסיין בטקסי זיכרון, וחלקם מכים ופוצעים את עצמם עד זוב דם.

לאורך השנים, פיתחה השיעה תיאולוגיה משלה והלָכה שונה מזו של הזרם המרכזי באיסלאם, הסונה, עד כדי כך שיש הטוענים שהסונה והשיעה הן שתי דתות שונות. סונים רבים רואים בשיעה סוג של כפירה, ושיעים לא מעטים רואים באופן זה את הסונים. שיעים רבים אף רואים בסוני "נג'ס" - טמא. השיעים טוענים שיש בקוראן שני פרקים המבססים את טענת השיעה לשלטון, ואילו הסונים טוענים ששני פרקים אלו הם זיוף שיעי. לאורך ההיסטוריה נחשבה השיעה קבוצה מורדת בשלטון, ולכן דינו של כל שיעי היה מוות. במקומות שבהם שלטה השיעה, זה היה גורלו של הסוני.

המאבק בין הסונה והשיעה נמשך במלוא עוזו עד היום הזה, כשאירן מובילה את הצד השיעי ואילו סעודיה היא חלוצת האיסלאם הסוני. בסעודיה שולטת האסכולה החנבלית בגרסה הווהאבית הקיצונית שלה, הרואה בשיעים כופרים. לכן השיעים הגרים במזרח סעודיה מדוכאים עד עפר: אסור להם לקרוא לתפילה ברמקולים היות שקריאתם כוללת תוספת שיעית, אסור להם לציין בפומבי את העאשורא ואסור להם להפגין. השלטון הסעודי מתייחס אליהם בנחישות רבה וברגישות אפסית.

מלחמת אירן-עירק (1988-1980) שעלתה בחייהם של מיליון בני אדם בשני הצדדים, הייתה חלק מן המאבק בין השיעה והסונה, שכן סדאם חוסיין היה סוני. בלבנון, חיזבאללה השיעי נאבק בסונים ובחבריהם על ההגמוניה בארץ ארזים, ובבחריין הרוב השיעי דובר הפרסית מנסה זה שנים להשתחרר מן המיעוט הסוני השולט בו ביד רמה. בשנה האחרונה, כשרוחות "האביב הערבי" הוציאו את הרוב השיעי לרחובות, כבשה סעודיה את בחריין והחזירה את השד השיעי לבקבוק.

בלבנון, ארגון חיזבאללה בחר לעצמו שם זה ("קבוצת אללה") כמסר שהשיעים שייכים לאללה, בעוד שהסונים, הנוצרים, הדרוזים, הציונים וכל האחרים הם "חזב אלשַיְטָאן" ("קבוצת השטן"). מאבקו של חיזבאללה הוא קודם כל מאבק עדתי ורק אחר כך - לאומי או פוליטי.

גם מלחמת האזרחים בסוריה היא המשך של מאבק השיעה נגד הסונה: העלאווים השולטים בסוריה מציגים את עצמם ככת שיעית, שכן הם רואים בעלי בן אבי טאלב, מייסד השיעה, את התגלמות האלוהות בגוף אדם. לכן הקואליציה השיעית הכוללת את אירן וחיזבאללה עומדת לצידם, ומולה התייצבה קואליציה סונית - סעודיה, קטר וטורקיה. המלחמה היא "על כל הקופה": על השלטון, על עצם הקיום ועל השאלה מי העדה האיסלאמית האמיתית, זו שתינצל מהגיהנום: השיעית או הסונית. ובינתיים שתיהן עושות גיהנום זו לזו.

סלפים - סונים

רבים כיום חוששים מתחיית האיסלאם בעקבות "האביב הערבי". זה החל בתקווה גדולה לדמוקרטיה שתציף את המזרח התיכון, אך הגיע עד להשתלטות המפלגות האיסלאמיות על מצרים ותוניסיה, ולעליית כוחן של המפלגות האיסלאמיות במרוקו ובכווית. המיליציות הג'יהאדיסטיות הרבות הפועלות בסוריה נגד שלטון הבעת' הסוציאליסטי החילוני מגבירות את הדאגה מן האיסלאם הלוחמני, ובעיקר אם יצליחו המיליציות הללו לשים את ידן על נשק להשמדה המונית הנמצא בסוריה בכמויות גדולות.

בתוך כל הבליל הזה הופיעה על הבימה הפוליטית תופעת הסלפים. ארגונים אלה שואפים להחזיר את החברות האיסלאמיות אל סגנון החיים של "אלסלף אלצאלח" - "הקדמונים הצדיקים" - שחיו במאה השביעית לספירה, ומכאן שמם. חלקם עושים זאת באמצעות דעווה, כלומר פעילות חברתית, אך חלקם דוחקים את הקץ ומשתמשים בג'יהאד המלחמתי להשגת מטרתם. במצרים התנועות הסלפיות שהצטרפו לפוליטיקה בשנה האחרונה זכו ברבע ממושבי הפרלמנט, ובסוריה מיליציות אנטי-שלטוניות רבות נושאות סממנים סלפיים ג'יהאדיסטים.

קבוצות סלפיות אלימות משחיתות בקביעות מונומנטים שהקימו קבוצות הנתפסות בעיניהן ככופרות: הטליבאן באפגניסטן השחיתו במארס 2001 את פסלי בודהה; לפני כחודשיים השחיתו קבוצות סלפיות מציבות ומבנים של צופים (פלג מיסטי איסלאמי) בטימבוקטו שבמאלי, וב-25 באוגוסט האחרון, לאור היום, הרסה קבוצה סלפית מסגד וכיפה של צופים בטריפולי, בירת לוב, ואיש לא העז למנוע זאת: הנשק שנשאו ההורסים שכנע את האחרים להישאר בטווח ביטחון.

בתוניסיה שלאחר "האביב הערבי" פועלות כמה קבוצות סלפיות, ולאחרונה התפרסם קליפ המציג אחת מהן בטקס שבו חבריה שוחטים בחור שהעז להתנצר. חלק מהקבוצות האלימות הפועלות בעירק מאז 2003, וכיום ברצועת עזה, בחצי האי סיני, בסעודיה, בסוריה, בתימן, באלג'יריה, במרוקו, בצ'צ'ניה, בבלוצ'יסטן האירנית, בכורדיסטן (העירקית, הסורית, הטורקית והאירנית), בפקיסטן, באפגניסטן, בפיליפינים, בניגריה, בקניה, בסומליה ובמדינות רבות אחרות - מציגות את עצמן כסלפיות ג'יהאדיסטיות, כשמעל כולן מרחפת דמותו בת האלמוות שלאוסאמה בן-לאדן והמודל המצליח של אל-קאעידה.

יש לציין כי אומנם הסלפים הם סונים, אך המאבק שהם מנהלים הוא נגד סונים, שיעים, נוצרים, יהודים וכופרים באותה מידה. בעיניהם, כל מי שאינו סלפי ג'יהאדיסטי הוא יורש גיהנום, בעולם הבא כמו בעולם הזה, והסלפים הג'יהאדיסטים הם הממונים מטעם עצמם על גובה הלהבות שעליהן ייצלה כל מי שאינו שותף לדרכם.

האויב המשותף

לשני הצדדים המאבק העדתי - הסונים והשיעים - יש אויב משותף, הלא הוא המערב בכלל המהווה אויב אידיאולוגי ותרבותי, בעוד שארצות-הברית וישראל הן האויב הקונקרטי, הצבאי והפוליטי. אלא שהאויב המשותף אינו מצליח בדרך כלל לחבר את הניצים הללו. יתר על כן, לעתים צד אחד - בדרך כלל הסוני - מסתייע במערב כדי להתמודד בהצלחה רבה יותר עם הצד השיעי. כך מוסברת הברית ארוכת השנים בין ארה"ב וסעודיה, הרחוקות כל כך תרבותית זו מזו.

ייתכן שגם הסכם השלום בין ישראל ומצרים, שנחתם במארס 1979, היה במידה מסוימת תגובה למהפכת האייותאללה באירן שהתרחשה חודשיים קודם לכן. 

ההתנגשות

ההתגוששות בין הסונה הסלפית הג'יהאדיסטית ובין השיעה נמשכת כבר כמעט 1400 שנה, ולא חדלה גם בדור האחרון. בשנים האחרונות יש כמה זירות בעולם הערבי שבהן מתקיימת התגוששות מדממת בין השיעים והסלפים:
  • בעירק מאז 2003 מתנהל מאבק איתנים שבו בצד אחד נמצאות מיליציות שיעיות שאירן מממנת, מחמשת ומאמנת, ובראשן "צבא המהדי" של מוסא צדר, כמו גם ארגונים ציבוריים ומפלגות פוליטיות העושים את דברה של אירן. מנגד ניצבות מיליציות סוניות, ובראשן "אל-קאעידה של ארץ הנהריים" שמממנות סעודיה ואמירויות המפרץ.

  • סוריה בשנה האחרונה משמשת זירת קרב-איתנים בין השלטון הממומן ונתמך על-ידי אירן, ובין מיליציות סוניות סלפיות הפועלות בכסף ובנשק מסעודיה, קטר וטורקיה - כולן מדינות סוניות. מדינות אלו עושות כל מה שהן יכולות על-מנת לבתר את הזרוע הסורית של התמנון האירני, ובכך להקטין את האיום של אירן על העולם הסוני בכלל ועל המפרץ במיוחד.

  • לבנון, מאז תחילת שנות ה-80', היא זירת התגוששות בין חיזבאללה הנתמך בידי אירן השיעית, ובין שאר העדות בראשות הסונים ומנהיגים כמו רפיק אלחרירי. הוא אומנם לא היה סלפי, אבל המשטר הסעודי שתמך בו הוא סלפי בהגדרת עצמו. לא לשווא מסייע חיזבאללה למשטר הסורי לעמוד בפני הסונים המורדים בו בשנה ומחצה האחרונות.

  • ההתנגשות בין הצדדים מוגברת על-ידי פסקי הלכה מצד שני הצדדים, המשמשים לכל אחד מהם אמצעי לקעקוע הלגיטימיות של הצד האחר. הדת הופכת כך לכלי שרת בידי סכסוך שבמקורו הוא משפחתי-שבטי - בין בתי אב בשבט קורייש - על מורשתו של מוחמד.

  • יש מקרים של חציית קווים: אירן השיעית וגרורותיה, סוריה וחיזבאללה תמכו בארגוני הטרור הפלשתינים הסוניים, חמאס והג'יהאד האיסלאמי. אך לאחר פרוץ האלימות בסוריה, נאלצו אנשי חמאס לצאת מדמשק ולנתק את קשריהם עם אירן, בגלל אי-יכולתם להסכים לטבח הסונים בידי השלטון הסורי.

  • גם ביקורים הדדיים בין מנהיגיהם של שני הצדדים אינם יכולים לגשר על פני 1400 שנות שנאה ומעשי טבח הדדיים. אחמדינג'אד ביקר בסעודיה, ומוחמד מורסי ואיסמעיל הנייה אומנם ביקרו באירן. אך ביקורים אלה אינם משנים מיסודה את העוינות בין הצדדים, ושגרירויות שפותחים הצדדים זה אצל זה משמשות בעיקר כבסיסי ריגול וחתרנות.

  • קיימת תחרות בין שני הצדדים מי מהם ינהל ג'יהאד מוצלח יותר נגד האויב המשותף - המערב, ארה"ב וישראל. התחרות מקורה באמונה שהצלחה בהפקת פעולות טרור מגדילה את הפופולריות והלגיטימיות של הצד המצליח. לכן, כל הצלחה של צד אחד בהפקת פעולה נגד המערב מגדילה את המוטיבציה של הצד האחר להפיק פעולה מוצלחת יותר: הצלחת חיזבאללה השיעי לסלק את ישראל מדרום לבנון במאי 2000 דחפה את הפלשתינים הסונים לפתוח באינתיפאדה השנייה בסוף ספטמבר 2000, ואת אל-קאעידה לפגע בארה"ב שנה לאחר מכן, בספטמבר 2001.

תובנות ומסקנות
  • האיסלאמיזציה במזרח התיכון היא תופעה קיימת, והשפעתן הגוברת של מפלגות איסלאמיות על החיים הפוליטיים היא מוחשית ואמיתית. עם זאת, תופעה חשובה וחזקה יותר היא צאתו של השד העדתי מהבקבוק שבו הוא היה כלוא כל עוד שלטו הדיקטטורים במרחב. מובארק במצרים, קדאפי בלוב, בן עלי בתוניסיה, צאלח בתימן ואסד בסוריה - ידעו והכירו אותו היטב, הן בגרסתו השיעית והן בגרסתו הסונית, ונקטו כל אמצעי שהיה ברשותם, בעיקר מרתפי עינויים, כדי לטפל בג'יהאדיזם העדתי שאין לו מגבלות של חוק או מוסר. כיום הדיקטטורים מסולקים זה אחר זה, והג'יהאדיזם פורח.

  • תנועה איסלאמיסטית שהגיעה לשלטון, גם אם היא מתנהגת כמקובל, עלולה לשאת ברחמה קבוצה ג'יהאדיסטית שתהפוך את חיי הקבוצה האם לגיהנום. שלטון איסלאמי כמו זה הקיים במצרים, סעודיה, עזה או אירן, נוטה להעלים עין מהקבוצות הקיצוניות, שכן הוא רואה בחבריהן אנשים טובים ונאמנים יותר ממנו לאיסלאם המקורי. רק כאשר קבוצות אלו פוגעות בשלטון, מתעורר זה לפעולה נגדן. אבל פעולה זו תהיה תמיד מוגבלת, בשל אי-רצונו להתנהג כמו הדיקטטור שסולק. השלטון יעדיף להגיע להסדרים עם הקבוצות הג'יהאדיסטיות, אבל הסדרים אלה הם קצרי מועד, בשל אופיין הרדיקלי של הקבוצות, ונטייתן לדחות כל שלטון.

  • על מדינות שיש בהן ציבורים של מהגרים איסלאמיים לעמוד על המשמר ולפקח היטב על הנעשה בקרב קבוצות מהגרים בדלניות השומרות בקנאות על סממנים מסורתיים, שכן יש סיכוי לא קטן שקבוצות אלו יפַתחו מאפיינים ג'יהאדיסטיים. פעילותן הג'יהאדיסטית תשים את המדינה המארחת למטרה, אך גם את קבוצת האם האתנית, שאינה די פעילה ואינה די נאמנה לאיסלאם בעיניהן של קבוצות הג'יהאד המהגרות. אלו מורכבות בדרך כלל מבני מולדת אחת. הן קשות מאוד לחדירה מודיעינית שכן הן סגורות, ומבוססות על היכרות אישית ונאמנות מוחלטת לקבוצה. ככל שהקבוצה קטנה יותר והומוגנית יותר, כן היא עלולה להיות מסוכנת יותר.

  • אירן מקיימת קשר עם קבוצות ג'יהאדיסטיות, בעיקר שיעיות, בכל רחבי העולם, המשמשות לה "תאים רדומים" הממתינים לפקודתה. שקי הדואר הדיפלומטי של אירן, שאינם עוברים ביקורת ביטחון במדינות המארחות, משמשים להעברת אמצעי לחימה לתאים רדומים אלה. שגרירויות אירן בכל העולם משמשות מחסני נשק, תחמושת ואמצעי חבלה, כמו שהן משמשות כבסיסי מודיעין, ומרכזים להפעלת סוכנים ומשתפי פעולה. יש להניח כי חלק משגרירויות סעודיה נמצאות בקשר דומה עם סונים מקומיים. מעקב אחרי שגרירויות אלה ופעילות אנשיהן יכול לספק למנגנוני הביטחון של המדינה המארחת מידע רב על פעילות חתרנית וג'יהאדיסטית המתבצעת בשטחה.

דו''ח אדמונד לוי על מעמד הבנייה באזור יהודה ושומרון


השופט אדמונד לוי הגיש ליועמ"ש את מסקנות דו"ח המאחזים שלו - לישראל מותר להתיישב ע"פ הדין הבינלאומי בכל יו"ש. פיצוי במקום פינוי. 


יו"ר הועדה שזכתה לכינוי 'ועדת המאחזים', שופט בית המשפט העליון בדימוס, אדמונד לוי, קובע במסקנות הדו"ח עליו עמלה הועדה בחודשים האחרונים כי לישראל הזכות להתיישב בכל רחבי יהודה ושומרון, כך על פי המשפט הבינלאומי.

השופט לוי מוסיף ומדגיש בדו"ח כי זכותה של ישראל להתיישב בשטחים שבידיה על פי ההסכמים עם הרשות הפלשתינית. כך על פי דיווח ב'ישראל היום'.

את ממצאי הדו"ח העביר השופט לוי לבחינתו של היועץ המשפטי לממשלה, עו"ד יהודה ויינשטיין.

"בתום בחינת עבודה הוועדה ובהתחשב בדברים שנשמעו, המסקנה הבסיסית היא שמנקודת המבט של המשפט הבינלאומי אין דיני 'הכיבוש' חלים בנסיבות ההיסטוריות והמשפטיות המיוחדות של הנוכחות הישראלית ביהודה ושומרון במשך עשרות שנים. כמו כן, אמנת ז'נבה הרביעית בעניין העברת אוכלוסייה אינן חלות ולא נועדה לחול לגבי התיישבות דוגמת זו של ישראל ביו"ש", מצטט העיתון מתוך הדו"ח.

עם זאת צוין בדו"ח כי "ללא אישור הממשלה, הוקמו עשרות שכונות חדשות, לעיתים ללא קיומו של קשר קרקעי רצוף עם יישובי האם, ואף מחוץ לתחום השיפוט שנקבע לו. תופעה נרחבת זו דרשה מימון רב ולכן הוועדה מתקשה להאמין כי נעלמה מעיניהם של שרי הממשלה ואלה שעמדו בראשה".

הועדה קובעת כי במקרה שנבנו ישובים המוגדרים כבלתי מורשים על אדמות מדינה או אדמות שנרכשו ע"י ישראלים, בסיוע של גורמים ממלכתיים, הרי שאין מקום להרוס ולפנות את הישובים ומהלך כזה אינו מעשי. משום כך יש למצוא חלופות בדמות פיצוי לבעלי הקרקע. הועדה קובעת שהמדינה עצמה הובילה למציאות הנוכחית ועל כן אין מקום לבצע הרס בישובים.

הועדה מסכמת וממליצה לממשלה להבהיר את מדיניותה בשאלת ההתיישבות הישראלית ביו"ש כדי למנוע פרשנות של החלטותיה; יישוב חדש יוקם רק לאחר שהממשלה או ועדת שרים שהוסמכה החליטה על כך; והרחבתו של יישוב אל מחוץ לתחום השיפוט טעונה החלטה של שר הביטחון או ועדת שרים לענייני התיישבות, וזאת בידיעת ראש הממשלה.

ועדת לוי ממליצה עוד כי כדי למנוע אי ודאות וכדי לקדם היציבות, מוצע שישראלים ופלשתינים ירשמו את זכויותיהם בקרקעות בתוך תקופת זמן מוגדרת, שבין ארבע לחמש שנים. בסופה מי שלא יבצע את הרישום יאבד את זכויותיו.

כאמור, מסקנות הועדה הועברו לבחינתו של היועץ המשפטי לממשלה ובהמשך יוגשו לראש הממשלה לקבלת החלטות ברוח הדו"ח. 

השטחים הלא כבושים

אתמול חמקה מתחת לרדאר התקשורתי ידיעת השבוע, אולי ידיעת השנה: עדנה אדטו חשפה אצלנו ב"ישראל היום" את עיקרי דו"ח הוועדה לבחינת מצב הבנייה ביהודה ושומרון בראשות שופט בית המשפט העליון בדימוס אדמונד לוי. בשקט נוגע הדו"ח בליבת הסכסוך הישראלי-פלשתיני ועושה בו סדר. אפשר לומר שהממשלה קיבלה אישור רשמי להשליך את דו"ח המאחזים של טליה ששון לפח ההיסטוריה.

הדו"ח הנוכחי קובע שיש לישראל זכות ליישב יהודים ביהודה ושומרון, וכי האמירה שההתנחלויות הן מעשה המנוגד לחוק הבינלאומי אינה נכונה:

"על פי המשפט הבינלאומי עומדת לישראלים זכות שבדין להתיישב בכל יהודה ושומרון, ולכל הפחות בשטחים הנתונים לשליטתה של ישראל מכוח הסכמים עם הרשות הפלשתינית, ועל כן ההקמה של היישובים בפני עצמה אינה לוקה באי חוקיות". עוד קובעת הוועדה כי "מנקודת המבט של המשפט הבינלאומי, אין דיני 'הכיבוש' חלים בנסיבות ההיסטוריות והמשפטיות המיוחדות של הנוכחות הישראלית ביהודה ושומרון במשך עשרות שנים".

מאז שנות ה-70 טענו משפטנים בכירים בארץ ובעולם שלישראל זכות מלאה ליישב את אזרחיה בשטחי יהודה ושומרון. אבל מאז מלחמת ששת הימים נמנעה ישראל מלקבוע מעמד סופי בשטחים שהשיגה, למעט ירושלים ורמת הגולן. אל הוואקום הזה הכניסו אהרן ברק ואחרים את הפרדיגמה המשפטית של "תפיסה לוחמתית" (Belligerent Occupation), שלפיה הממשל הצבאי שואב את כוחו מכללי המשפט הבינלאומי ביחס לשטחים שנתפסו במלחמה. המשמעות היא שישראל נחשבת לכאורה פולש זר, ואין לה זכות להחיל ריבונות או להעביר לשם אוכלוסייה אזרחית וכו'. חלק ניכר מהצעדים שגורמים משפטיים ופוליטיים עוינים ביצעו נגד מפעל ההתיישבות ביו"ש, נבעו מהתפיסה הזאת. המהלכים הללו, שמטרתם היתה חנק מפעל ההתיישבות, קיבלו בפרקליטות צידוק באמצעות התפיסה הלוחמתית.

אם השטחים אינם כבושים, טען השמאל במשך שנים, יש לספחם, לרבות האוכלוסייה שבתוכם. אבל המציאות אינה קוטבית אלא מורכבת. הדו"ח הנוכחי מכיר במצב ביניים: מדובר בשטח שבמחלוקת; "שניים אוחזין" בשטח, איש מהם אינו נחשב "כובש". קיימת מחלוקת על הבעלות שצריכה להתברר באמצעים שונים, אבל אין כאן הגדרה של "כיבוש" במובן המשפטי הבינלאומי.

The British Mandate for Palestine, shortly Mandate for Palestine, or the Palestine Mandate was a League of Nations mandate for the territory that had formerly constituted the Ottoman Empire sanjaks of NablusAcre, the Southern part of the Vilayet of Syria,[1] the Southern portion of the Beirut Vilayet, and the Mutasarrifate of Jerusalem, prior to the Armistice of Mudros.
The draft of the Mandate for Palestine was formally confirmed by the Council of the League of Nations on 24 July 1922, supplemented via the 16 September 1922 Trans-Jordan memorandum[2][3] and then came into effect on 29 September 1923[2] following the ratification of the Treaty of Lausanne.[4][5] The mandate ended at midnight on 14 May 1948. The Palestine Mandate legalized the temporary rule of Palestine by Great Britain.
The document was based on the principles contained in Article 22 of the Covenant of the League of Nations and the San Remo Resolution of 25 April 1920, by the principal Allied and associated powers after the First World War. The objective of the League of Nations Mandate system was to administer parts of the defunct Ottoman Empire, which had been in control of the Middle East since the 16th century, "until such time as they are able to stand alone."[6] The approximate northern border with the French Mandate was agreed upon in the Paulet–Newcombe Agreement of 23 December 1920.[7]
Transjordan had been a no man's land following the July 1920 Battle of Maysalun.[8] During this period, the British chose to avoid any definite connection with Palestine[9] until a March 1921 conference at which it was agreed thatAbdullah bin Hussein would administer the territory under the auspices of the Palestine Mandate. The Trans-Jordan Memorandum annulled the articles regarding the Jewish National Home in the territory east of the Jordan. It also established a separate "Administration of Trans-Jordan" for the application of the Mandate, under the general supervision of Great Britain. On 18 April 1946, Transjordan was formally separated from the Palestine Mandate,[10] with Abdullah remaining the king.

When the Ottoman Empire joined the Central Powers in the First World War in April 1915, it threatened Britain's communications with India via the Suez Canal, besides other strategic interests of the allies. The conquest of Palestine became part of British strategies aimed at establishing a land bridge between the Mediterranean and the Persian Gulf. This would enable rapid deployment of troops to the Gulf, then the forward line of defence for British interests in India, and protect against invasion from the north by Russia. A land bridge was also an alternative to the Suez Canal.[11]
In response to French initiatives, the United Kingdom established the de Bunsen Committee in 1915 to consider the nature of British objectives in Turkey and Asia in the event of a successful conclusion of the war. The committee considered various scenarios and provided guidelines for negotiations with France, Italy, and Russia regarding the partitioning of the Ottoman Empire. The Committee recommended in favour of the creation of a decentralised and federal Ottoman state in Asia.[12]
At the same time, the British and French also opened overseas fronts with the Gallipoli (1915) and Mesopotamiancampaigns. In Gallipoli, the Turks successfully repelled the British, French and Australian and New Zealand Army Corps(ANZACs).
From 1915, Zionist leader and anglophile Ze'ev Jabotinsky was pressing the British to agree to the formation of a Zionist volunteer corps that would serve under the aegis of the British army. The British eventually agreed to set up the Zion Mule Corps, which assisted in the failed invasion of Gallipoli. After Lloyd George was made prime minister during the war, the British waged the Sinai and Palestine Campaign under General Allenby. This time the British agreed to a "Jewish Legion", which participated in the invasion. Russian Jews regarded the German army as a liberator and the creation of the Legion was designed to encourage them to participate in the war on Britain's side.
At the same time, British intelligence officer T. E. Lawrence ("Lawrence of Arabia") was encouraging an Arab Revolt led by the Sharif of Mecca.
The British defeated Ottoman Turkish forces in 1917 and occupied Ottoman Syria, which would later be divided to British Palestine and TransJordan andFrench Syria and Lebanon. The land remained under British military administration for the remainder of the war, and beyond.

Occupied Enemy Territory Administration[edit]

The Ottoman Empire capitulated on 30 October 1918, and on 23 November 1918, a military edict was issued dividing Ottoman territories into "occupied enemy territory administrations" (OETAs). The Middle East was divided into three OETAs. Occupied Enemy Territory Administration South extended from the Egyptian border of Sinai into Palestine and Lebanon as far north as Acre and Nablus and as far east as the River Jordan. A temporary British military governor Major General Sir Arthur Wigram Money would administer this sector.[13][14][15] At that time, General Allenby assuredAmir Faisal "that the Allies were in honour bound to endeavour to reach a settlement in accordance with the wishes of the peoples concerned and urged him to place his trust whole-heartedly in their good faith."[16]
In October 1919, British forces in Syria and the last British soldiers stationed east of the Jordan were withdrawn and the region came under exclusive control of Faisal bin Hussein from Damascus. [17]

Negotiations[edit]

In 1916, Britain and France concluded the Sykes–Picot Agreement, which proposed to divide the Middle East between them into spheres of influence, with "Palestine" as an international enclave.[19] The British made two potentially conflicting promises regarding the territory it was expecting to acquire.[citation needed] In the McMahon-Hussein Correspondence of 1915 Britain had promised Hussein bin Ali, Sharif of Mecca, through T. E. Lawrence, independence for an Arab country covering most of the Arab Middle East in exchange for his support, while also promising to create and foster a Jewish national home in Palestine in the Balfour Declaration of 1917.
The Sykes-Picot Agreement did not call for Arab sovereignty, but for the "suzerainty of an Arab chief" and "an international administration, the form of which is to be decided upon after consultation with Russia, and subsequently in consultation with the other allies, and the representatives of the Sherif of Mecca."[20] Under the terms of that agreement, the Zionist Organization needed to secure an agreement along the lines of the Faisal-Weizmann Agreement with the Sherif of Mecca.
At the Peace Conference in 1919, Emir Faisal, speaking on behalf of King Hussein, asked for Arab independence, or at minimum the right to pick the mandatory.[21] In the end, he recommended an Arab state under a British mandate.[22]The World Zionist Organization also asked for a British mandate, and asserted the 'historic title of the Jewish people to Palestine'.[23]
A confidential appendix to the report of the 1919 King-Crane Commission observed that "The Jews are distinctly for Britain as mandatory power, because of the Balfour declaration' and that the French 'resent the payment by the English to the Emir Faisal of a large monthly subsidy, which they claim covers a multitude of bribes, and enables the British to stand off and show clean hands while Arab agents do dirty work in their interest."[24] The Faisal-Weizmann Agreementcalled for British mediation of any disputes. It also called for the establishment of borders, after the Versailles peace conference, by a commission to be formed for the purpose. The World Zionist Organization later submitted to the peace conference a proposed map of the territory that did not include the area east of the Hedjaz Railway, including most ofTransjordan. In the San Remo Conference (24 April 1920) the Mandate for Palestine was allocated to Great Britain. France required the continuation of its religious protectorate in Palestine but Italy and Great Britain opposed it. France lost the religious protectorate but thanks to the Holy See continued to enjoy liturgical honors in Mandatory Palestine until 1924 when the honours were abolished (see: Protectorate of the Holy See).[25]
During and after World War I, Britain made conflicting and shifting commitments regarding the future division and governance of the region, including those announced in the Balfour Declaration of 1917, the Sykes-Picot Agreement, the McMahon–Hussein Correspondence, and the Churchill White Paper of 1922. At the San Remo conference, the boundaries of the mandated territories were not precisely defined.[26]Chaim Weizmann subsequently reported to his colleagues in London: "There are still important details outstanding, such as the actual terms of the mandate and the question of the boundaries in Palestine. There is the delimitation of the boundary between French Syria and Palestine, which will constitute the northern frontier and the eastern line of demarcation, adjoining Arab Syria. The latter is not likely to be fixed until the Emir Faisal attends the Peace Conference, probably in Paris."[27]
In a meeting at Deauville in 1919, David Lloyd George of the UK and Georges Clemenceau of France finalised the Anglo-French Settlement of 1–4 December 1918. The new agreement allocated Palestine and the Vilayet of Mosul to the British in exchange for British support of French influence in Syria and Lebanon.[28][29]
At the Paris Peace Conference, Prime Minister Lloyd George told Georges Clemenceau and the other allies that the McMahon-Hussein correspondence was a treaty obligation. He explained that the agreement with Hussein had actually been the basis for the Sykes-Picot Agreement, and that the French could not use the proposed League Of Nations Mandate system to break the terms of the agreement. He pointed out that the French had agreed not to occupy the area of the independent Arab state, or confederation of states, with their military forces, including the areas of Damascus, HomsHama, and AleppoArthur Balfour(later Lord Balfour, British Foreign Secretary at the time) and President Woodrow Wilson were present at the meeting.[30]
The open negotiations began at the Paris Peace Conference, continued at the Conference of London and took definite shape only after the San Remo conference in April 1920. There the Allied Supreme Council granted the mandates for Palestine and Mesopotamia to Britain,[26] and those for Syria and Lebanon to France. In August 1920, this was officially acknowledged in the Treaty of Sèvres. Both Zionist and Arab representatives attended the conference, where they signed the Faisal–Weizmann Agreement.[31] The agreement was never implemented.
The San Remo conference[32] assigned the mandate for Palestine to the United Kingdom under Article 22 of the Covenant of the League of Nations. The Allies also decided to make the UK responsible for putting into effect its own Balfour Declaration of 1917.

Legal basis and drafting of the mandate[edit]

The mandate was a legal and administrative instrument, not a geographical territory.[33] The territorial jurisdiction of the mandate was subject to change by treaty, capitulation, grant, usage, sufferance or other lawful means.
The document was based on the principles contained in Article 22 of the draft Covenant of the League of Nations and the San Remo Resolution of 25 April 1920 by the principal Allied and associated powers after the First World War.[2] The mandate formalised British rule in the southern part of Ottoman Syria from 1923–1948.
Each of the principal Allied powers had a hand in drafting the proposed mandate[34]—although some, including the United States, had not declared war on the Ottoman Empire and did not become members of the League of Nations.
Spring 1919, at the Paris Peace Conference, informal discussion began between the Zionist Organisation and British representatives. A first draft was presented on 15 July 1919.[35] After Lord Curzon had replaced Arthur Balfour as Foreign Secretary, the draft was reconsidered. A second draft was presented on 10 June 1920. In the second draft, the paragraph recognizing the historical connection of the Jewish people with Palestine was removed from the preamble. "self-governing commonwealth" was replaced by "self-governing institutions". Also, "The recognition of the establishment of the Jewish National Home as the guiding principle in the execution of the Mandate" was omitted from the first draft. After strenuous objection to the proposed changes, the statement regarding the historical connections of the Jews with Palestine was re-incorporated into the Mandate in December 1920.[35] The draft was submitted to the League of Nations on 6 December 1920.[36]

Establishment of a national home for the Jewish people[edit]

The preamble of the mandate document declared:
Whereas the Principal Allied Powers have also agreed that the Mandatory should be responsible for putting into effect the declaration originally made on November 2nd, 1917, by the Government of His Britannic Majesty, and adopted by the said Powers, in favour of the establishment in Palestine of a national home for the Jewish people, it being clearly understood that nothing should be done which might prejudice the civil and religious rights of existing non-Jewish communities in Palestine, or the rights and political status enjoyed by Jews in any other country.[37]
The British Foreign Secretary, Lord Curzon, together with the Italian and French governments rejected early drafts of the mandate because they had contained a passage which read: "Recognizing, moreover, the historical connection of the Jewish people with Palestine and the claim which this gives them to reconstitute it their national home..."[38]
The Palestine Committee set up by the Foreign Office recommended that the reference to 'the claim' be omitted. The Allies had already noted the historical connection in the Treaty of Sèvres, but they had not acknowledged a legal claim. Lord Balfour suggested an alternative which was accepted:
Whereas recognition has thereby [i.e. by the Treaty of Sèvres] been given to the historical connection of the Jewish people with Palestine, and to the grounds for reconstituting their National Home in that country ...[39]
The Vatican, the Italian, and the French governments continued to press their own legal claims on the basis of the former Protectorate of the Holy See and the French Protectorate of Jerusalem. The idea of an International Commission to resolve claims on the Holy Places had been formalised in Article 95 of the Treaty of Sèvres, and taken up again in article 14 of the Palestinian Mandate. Negotiations concerning the formation and the role of the commission were partly responsible for the delay in ratifying the mandate. The UK assumed responsibility for the Holy Places under Article 13 of the mandate. However, it never created the Commission on Holy Places to resolve the other claims in accordance with Article 14 of the mandate.[40]
The High Commissioner established the authority of the Orthodox Rabbinate over the members of the Jewish community and retained a modified version of the old Ottoman Millet system. Formal recognition was extended to eleven religious communities, which did not include the non-Orthodox Jewish or Protestant Christian denominations.

Article 22 of the Covenant of the League of Nations[edit]

The preamble of the Mandate document states that the Mandate is granted to Britain "for the purpose of giving effect to the provisions of Article 22 of the Covenant of the League of Nations". That article, which concerns entrusting "tutelage" of colonies formerly under German and Turkish sovereignty to "advanced nations" with specific regard to "[c]ommunities formerly belonging to the Turkish Empire" that they "have reached a stage of development where their existence as independent nations can be provisionally recognised subject to the rendering of administrative advice and assistance by a Mandatory until such time as they are able to stand alone." Throughout the period of the Mandate, Palestinian leaders cited this as proving their assertion that the British were obliged under the terms of the Mandate to facilitate the eventual creation of an independent Arab state in Palestine.

Transjordan[edit]

Background and negotiations[edit]

The future Transjordan had been part of the Syrian administrative unit under the Ottomans. It was part of the captured territory placed under the Allied Occupied Enemy Territory Administration (OETA).[41]
Under the terms of the McMahon-Hussein correspondence and Sykes-Picot agreements, Transjordan was to be part of an Arab state or confederation of Arab states. The proposed Arab state and Jewish national home called for separate boundaries and administrative regimes in the sub-districts of historical Palestine (west of the Jordan River) and Transjordan (east of the Jordan River). However, the area east of a line from DamascusHomsHamma, and Aleppo – including most of Transjordan – had been pledged in 1915 as part of an undertaking between the UK and the Sharif Hussein of Mecca. The area east of the Jordan River 'was included in the areas as to which Great Britain [sic] pledged itself that they should be Arab and independent in the future'. In 1918, the British military retreated from Trans-Jordan, in an indication of their political ideas about the future of the territory, which according to their position was designated to be part of the Arab Syrian state.[42]
In August 1919, Balfour stated that he wanted Palestine to be defined to include some of the lands lying east of the Jordan, but not the Hedjaz Railway.[36] At the 1919 Paris Peace Conference, the British officials presented a proposal including maps showing the eastern boundary of Palestine located just 10km east of the Jordan.[42]
At the Peace Conference, the Zionist Organization's claims did also not include any territory east of the Hedjaz Railway.[36] The railway ran parallel with and about 35-40 miles (about 60km) east of the Jordan river.[43] The Faisal-Weizmann Agreement provided that the boundaries between the Arab state and Palestine should be determined by a commission after the Paris Peace Conference.
On 13 September 1919, a memorandum was handed from Lloyd George to Georges Clemenceau which stated that British Palestine would be "defined in accordance with its ancient boundaries of Dan to Beersheba".[44]
The territory east of the Jordan between Damascus and Ma'an had been ruled as part of Faisal's Kingdom of Syriasince the end of the war. The British were content with that arrangement because Faisal was a British ally and the region fell within the indirect sphere of British influence according to the Sykes-Picot agreement.[45] They favoured Arab rule in the interior, because they didn't have enough troops to garrison the territory. Damascus was located in the French indirect sphere of influence, and the Sykes-Picot agreement called for Arab rule there too.
The boundaries of the Palestine Mandate were not defined when it was awarded in April 1920 at the San Remo conference. In a telegram to the Foreign Office summarising the conclusions of the San Remo conference, the Foreign Secretary, Lord Curzon, stated: "The boundaries will not be defined in Peace Treaty but are to be determined at a later date by principal Allied Powers". When Samuel set up the civil mandatory government in mid-1920 he asked to put parts of Transjordan directly under his administrative control but was declined due to London's unwillingness to commit any significant resources to this area.[46]Following the French occupation of Damascus in July 1920, the French, acting in accordance with their wartime agreements with Britain, refrained from extending their rule south into Transjordan. That autumn Emir Faisal's brother, Abdullah, led a band of armed men north from the Hedjaz into Transjordan and threatened to attack Syria and vindicate the Hashemites' right to overlordship there. In March 1921 the Colonial Secretary, Winston Churchill, convened theCairo Conference which endorsed an arrangement whereby Transjordan would be added to the Palestine mandate, with Abdullah as the emir under the authority of the High Commissioner, and with the condition that the Jewish National Home provisions of the Palestine mandate would not apply there.[47] When France occupied Damascus in July 1920, the situation had changed dramatically. The British suddenly wanted to know 'what is the "Syria" for which the French received a mandate at San Remo?' and "does it include Transjordania?".[45] British Foreign Minister Curzon ultimately decided that it did not and that Transjordan would remain independent, but in the closest relation with Palestine.[48]
At the Battle of Maysalun on 23 July 1920, the French removed the newly proclaimed nationalist government of Hashim al-Atassi and expelled King Faisal from Syria. The French formed a new Damascus state after the Battle of Maysalun, and the area of Transjordan became for a time a no-man's land.[8] As a result,Curzon instructed Vansittart in August 1920 to leave the eastern boundary of Palestine undefined, stating:
"His Majesty's Government are already treating 'Trans-Jordania' as separate from the Damascus State, while at the same time avoiding any definite connection between it and Palestine, thus leaving the way open for the establishment there, should it become advisable, of some form of independent Arab government, perhaps by arrangement with King Hussein or other Arab chiefs concerned."[9]
At the same time, British Foreign Secretary Earl Curzon wrote to the High Commissioner, Herbert Samuel, in August 1920, stating, "I suggest that you should let it be known forthwith that in the area south of the Sykes-Picot line, we will not admit French authority and that our policy for this area to be independent but in closest relations with Palestine."[49] Samuel replied to Curzon, "After the fall of Damascus a fortnight ago...Sheiks and tribes east of Jordan utterly dissatisfied with Shareefian Government most unlikely would accept revival."[50] He subsequently announced that Transjordan was under British Mandate.[51] Without authority from London, Samuel then visited Transjordan and at a meeting with 600 leaders in Salt, announced the independence of the area from Damascus and its absorption into the mandate, quadrupling the area under his control by tacit capitulation. Samuel assured his audience that Transjordan would not be merged with Palestine.[51][52] The foreign secretary, Lord Curzon, repudiated Samuel's action.[53]
Two months later, on 21 November, Abdullah, the brother of recently deposed King Faisal, marched into Ma'an at the head of an army of 300 men.[54][55]
In early 1921, prior to the convening of the Cairo Conference, the Middle East Department of the Colonial Office set out the situation as follows:[56]
Distinction to be drawn between Palestine and Trans-Jordan under the Mandate. His Majesty's Government are responsible under the terms of the Mandate for establishing in Palestine a national home for the Jewish people. They are also pledged by the assurances given to the Sherif of Mecca in 1915 to recognise and support the independence of the Arabs in those portions of the (Turkish) vilayet of Damascus in which they are free to act without detriment to French interests. The western boundary of the Turkish vilayet of Damascus before the war was the River Jordan. Palestine and Trans-Jordan do not, therefore, stand upon quite the same footing. At the same time, the two areas are economically interdependent, and their development must be considered as a single problem. Further, His Majesty's Government have been entrusted with the Mandate for "Palestine." If they wish to assert their claim to Trans-Jordan and to avoid raising with other Powers the legal status of that area, they can only do so by proceeding upon the assumption that Trans-Jordan forms part of the area covered by the Palestine Mandate. In default of this assumption Trans-Jordan would be left, under article 132 of the Treaty of Sevres, to the disposal of the principal Allied Powers. Some means must be found of giving effect in Trans-Jordan to the terms of the Mandate consistently with "recognition and support of the independence of the Arabs".[57]
The Cairo Conference of March 1921 was convened by Winston Churchill, then Britain's Colonial Secretary. With the mandates of Palestine and Iraq awarded to Britain, Churchill wished to consult with Middle East experts. At his request, Gertrude Bell, Sir Percy Cox, T. E. Lawrence, Sir Kinahan Cornwallis, Sir Arnold T. Wilson, Iraqi minister of war Jaʿfar alAskari, Iraqi minister of finance Sasun Effendi (Sasson Heskayl), and others gathered in Cairo, Egypt. An additional outstanding question was the policy to be adopted in Transjordan to prevent anti-French military actions from being launched within the allied British zone of influence. The Hashemites were Associated Powers during the war, and a peaceful solution was urgently needed. The two most significant decisions of the conference were to offer the throne of Iraq to Emir Faisal ibn Hussein (who became Faisal I of Iraq) and an emirate of Transjordan (now Jordan) to his brother Abdullah ibn Hussein (who became Abdullah I of Jordan). The conference provided the political blueprint for British administration in both Iraq and Transjordan, and in offering these two regions to the sons of Sharif Hussein ibn Ali of the Hedjaz, Churchill stated that the spirit, if not the letter, of Britain's wartime promises to the Arabs might be fulfilled. After further discussions between Churchill and Abdullah in Jerusalem, it was mutually agreed that Transjordan was accepted into the mandatory area as an Arab country apart from Palestine with the proviso that it would be, initially for six months, under the nominal rule of the Emir Abdullah and that it would not form part of the Jewish national home to be established west of the River Jordan.[58][59][60][61]
On 21 March 1921, the Foreign and Colonial office legal advisers decided to introduce Article 25 into the Palestine Mandate. It was approved by Curzon on 31 March 1921, and the revised final draft of the mandate (including Transjordan) was forwarded to the League of Nations on 22 July 1922.[62]

Article 25 and Transjordan memorandum[edit]

Article 25 permitted the mandatory to "postpone or withhold application of such provisions of the mandate as he may consider inapplicable to the existing local conditions" in that region. The final text of the Mandate includes an Article 25 which states:
"In the territories lying between the Jordan [river] and the eastern boundary of Palestine as ultimately determined, the Mandatory shall be entitled, with the consent of the Council of the League of Nations, to postpone or withhold application of such provisions of this mandate as he may consider inapplicable to the existing local conditions, and to make such provision for the administration of the territories as he may consider suitable to those conditions"[63]
On submission of the memorandum to the Council of the League of Nations, Balfour explained the background as recorded in the minutes: "Lord Balfour reminded his colleagues that Article 25 of the mandate for Palestine as approved by the Council in London on July 24th, 1922, provides that the territories in Palestine which lie east of the Jordan should be under a somewhat different regime from the rest of Palestine. ... The British Government now merely proposed to carry out this article. It had always been part of the policy contemplated by the League and accepted by the British Government, and the latter now desired to carry it into effect. In pursuance of the policy, embodied in Article 25, Lord Balfour invited the Council to pass a series of resolutions which modified the mandate as regards those territories. The object of these resolutions was to withdraw from Trans-Jordania the special provisions which were intended to provide a national home for the Jews west of the Jordan."[64]
When the Inter-Allied Conference at San Remo adjourned in April 1920, the definition of Palestine had not been discussed. In a recent essay, Sanford Silverburg stated that "a Palestine within the western political understanding of the term simply never existed." He observed that the failure to establish a western-based territorial element or frame of reference had clouded discussions and cited the claim that Transjordan had been detached from Palestine as a non-sequitur.[65]
That agreement was formalised before the mandate officially went into effect. An article was included in the Mandate for Palestine which allowed the UK to postpone or withhold unspecified provisions from the lands which lay to the east of the Jordan River.[63] On 16 September 1922, the League of Nations approved a British memorandum detailing its intended implementation of that clause, namely to exclude Transjordan from the articles related to Jewish settlement.[66][67]
With the League of Nations' consent on 16 September 1922, the Mandate territory was formalised by the UK with the creation of two administrative areas,Palestine, under direct British rule, and autonomous Transjordan, under the rule of the Hashemite family from the Kingdom of Hejaz in present-day Saudi Arabia, in accordance with the McMahon Correspondence of 1915.[2] Following the 1922 Transjordan memorandum, the area east of the Jordan river became exempt from the Mandate provisions concerning the Jewish National Home.[2][3]
The British Foreign Office confirmed the position in 1946, in discussions over the independence of Transjordan, stating that "the clauses of the Palestine Mandate relating to the establishment of a Jewish national home were, with the approval of the League of Nations, never applied in Transjordan. His Majesty's Government have therefore never considered themselves under any obligation to apply them there".[68]

Governance of Transjordan[edit]

Transfer of authority to an Arab government took place gradually in Transjordan, starting with Abdullah's appointment as Emir of Transjordan on 1 April 1921, and the formation of his first government on 11 April 1921.[69] The independent administration was recognised in a statement made in Amman on 25 April 1923: "Subject to the approval of the League of Nations, His Britannic Majesty will recognize the existence of an independent Government in Trans-jordan under the rule of His Highness the Amir Abdullah, provided that such Government is constitutional and places His Britannic Majesty in a position to fulfil his international obligations in respect of the territory by means of an Agreement to be concluded with His Highness"[70][71]
During the eleventh session of the League of NationsPermanent Mandates Commission in 1927, Sir John Shuckburgh summarised the status of Transjordan:
It is not part of Palestine but it is part of the area administered by the British Government under the authority of the Palestine Mandate. The special arrangements there really go back to the old controversy about our war time pledges to the Arabs which I have no wish to revive. The point is that on our own interpretation of those pledges the country East of the Jordan - though not the country West of the Jordan - falls within the area in respect of which we promised during the war to recognise and support the independence of the Arabs. Transjordan is in a wholly different position from Palestine and it was considered necessary that special arrangements should be made there[72]
Transfer of most administrative functions occurred in 1928, including the creation of the post of High Commissioner for Transjordan.[73] The status of the mandate was not altered by the agreement between the United Kingdom and the Emirate concluded on 20 February 1928.[74][75] It recognised the existence of an independent government in Transjordan and defined and limited its powers. The ratifications were exchanged on 31 October 1929."[76][77]
Britain retained mandatory authority over the region until it became independent as the Hashemite Kingdom of Transjordan in 1946. The juridical status of the mandate under the Palestine Mandate Convention remained unchanged pending a decision on the Palestine question by the United Nations or Transjordan's admission to the United Nations as an independent state. Religious and communal issues[edit]

Article 14 of the Mandate required Britain to establish a commission to study, define, and determine the rights and claims relating to the different religious communities in Palestine. This provision, which called for the creation of a commission to review the religious status quo between the religious communities, was never created.
Article 15 required the mandatory administration to see to it that complete freedom of conscience and the free exercise of all forms of worship were permitted.
The proviso to the objective of the mandate was that "nothing should be done which might prejudice the civil and religious rights of existing non-Jewish communities in Palestine".

Northern borders[edit]

The Northern boundary between the British and French mandates was defined in broad terms by the Franco-British Boundary Agreement of December 1920.[78] That agreement placed the bulk of the Golan Heights in the French sphere. The treaty also established a joint commission to settle the precise border and mark it on the ground.[78] The commission submitted its final report on 3 February 1922, and it was approved with some caveats by the British and French governments on 7 March 1923, several months before Britain and France assumed their Mandatory responsibilities on 29 September 1923.[79][80] Under the treaty, Syrian and Lebanese residents would have the same fishing and navigation rights on Lake HulaLake Tiberias, and the Jordan River as citizens of the Palestine Mandate, but the government of Palestine would be responsible for policing of the lakes. The Zionist movement pressured the French and British to include as much water sources as possible to Palestine during the demarcating negotiations. These constant demands influenced the negotiators and finally led to the inclusion of the whole Sea of Galilee, both sides of the Jordan riverLake Hula, Dan spring, and part of the Yarmouk. The High Commissioner of Palestine, Herbert Samuel, had demanded full control of the Sea of Galilee.[81] The new border followed a 10-meter wide strip along the northeastern shore.[82]
Following the settlement of the Northern border issue, the British and French governments signed on 2 February 1926 an Agreement of good neighbourly Relations between the mandated territories of Palestine, Syria and Lebanon.[83]

Southern borders[edit]

The Southern border between Palestine and Egypt was left unchanged from the border established between Egypt and the Ottoman Empire in 1906.[84]
The Southern border between Transjordan and Arabia was left undefined whilst Abdullah's father remained in power in theKingdom of Hejaz. However, following the 1924-25 Saudi conquest of Hejaz, the Hashemite army fled to the northern Ma'an province of Hejaz, which was then annexed by Transjordan. This was formalised by the 1925 Hadda agreement, with the resulting zig-zag border becoming known as Winston's Hiccup.[85]

Eastern borders[edit]

The Eastern border between Transjordan and Iraq was not agreed until 1922, and not formally documented until 1932.[86][87][88]

Administrative divisions in Palestine[edit]

The August 1922 Palestine Order in Council provided that:
The High Commissioner may, with the approval of a Secretary of State, by Proclamation divide Palestine into administrative divisions or districts in such manner and with such subdivisions as may be convenient for purposes of administration describing the boundaries thereof and assigning names thereto.[89]

Approvals and Ratification[edit]

Ottoman / Turkish ratification[edit]

The decision taken by the Allied Supreme Council at the San Remo conference was documented in the Treaty of Sèvres, signed on behalf of the Ottoman Empire and Allies on 10 August 1920. However, the treaty was never ratified by the Ottoman government,[90] because it required the agreement of Mustafa Kemal Atatürk. Ataturk expressed disdain for the treaty, and continued the fight known as the Turkish War of Independence.
In November 1922, the Conference of Lausanne began, with the intention to negotiate a treaty to replace the failed Treaty of Sèvres. In the Treaty of Lausanne, signed on 24 July 1923 and ratified on 28 September 1923,[90] the Turkish government finally recognised the detachment of the regions south of the frontier agreed in the Treaty of Ankara (1921), thereby making a general renunciation of its sovereignty over Palestine.[90]

League of Nations approval[edit]

The text of the Mandate for Palestine was approved by the Council of the League of Nations on 24 July 1922.[91] However, this would not come into effect until a treaty between the Turkish government and the Allies was ratified and a dispute between France and Italy over the Syria Mandate was settled. The latter requirement was due to the perceived need for the legal regime to begin at the same time as the French Mandate for Syria and the Lebanon
Following the ratification of the Treaty of Lausanne on 28 September 1923,[4][5][90] the dispute between France and Italy was reported as settled.[91][92][93] The Council of the League of Nations determined that the two mandates had come into effect at its meeting of 29 September 1923.
The Official Journal of the League of Nations, dated June 1922, contained an interview with Lord Balfour in which he opined that the League's authority was strictly limited. According to Balfour –
[the] Mandates were not the creation of the League, and they could not in substance be altered by the League. The League's duties were confined to seeing that the specific and detailed terms of the mandates were in accordance with the decisions taken by the Allied and Associated Powers, and that in carrying out these mandates the Mandatory Powers should be under the supervision—not under the control—of the League. A mandate was a self-imposed limitation by the conquerors on the sovereignty which they exercised over the conquered territory.[94]

United States acceptance[edit]

The United States was not a member of the League of Nations, and consequently was not required to officially state its position on the legality of the Palestinian Mandate. However, the US government accepted the de facto, if not de jure, status of the mandates and entered into individual treaties with the mandatory power to secure legal rights for its citizens and to protect property rights and business interests in the mandates. In the case of Palestine, on 3 December 1924, it entered into a bilateral treaty with Britain in the Palestine Mandate Convention, in which the United States "consents to the administration" (Article 1) and which dealt with eight issues of concern to the United States.[95][96]
